This Privacy Policy applies to information that we collect (“Information”). We collect Information from you when you interact with the Website. Such Information may include that which may personally identify you; that which is about you but does not individually identify you; and information about your internet connection, equipment, and usage details. Information we request may include, without limitation, name, email address, date of birth or other information. We may retain Information related to you for as long as your account is active or as needed to deliver products or provide you services through the Website. We may retain and use Information related to you, as necessary, to comply with our legal obligations, resolve disputes, and enforce our agreements. There might be latency in deleting Information from our servers, and backed-up versions might exist after deletion. In addition, we do not delete from our servers files or materials that you have in common with other users or Information that we may otherwise be required to maintain under this Privacy Policy, our Terms of Use or for compliance with other requirements, such as for legal purposes.

Personally Identifying Information

Personally Identifying Information, or “PII”, is Information that can be used on its own or with other information or data to identify, contact or locate a single person (including, without limitation, postal address, e-mail address, telephone number, social security number, or other similar identifiers). Your submission of, and our handling of, PII is governed by this Privacy Policy and your submission of any such PII constitutes acceptance of this Privacy Policy.

We may use your PII for purposes such as recognizing you when you return to our Website, expediting your searches, storing your preferences, responding to your requests, fulfilling your orders of products, monitoring and providing the services inherent in the Website, maintaining your account, enforcing our rights and the rights of third parties, investigating and ensuring compliance with the Terms of Use, and to contact you, if necessary, in relation to any of the foregoing.

We do not knowingly sell, and are not engaged in, the business of selling your Information or PII to third parties.

However, please know we do not currently sell data triggering that statute’s opt-out requirements.

To appeal a decision regarding a consumer rights request, please email us at Accallcenter@hcsc.org with your full name, state of residence, and the reasons that you are seeking an appeal. The Company ultimately upholds an individual’s rights to pursue legally-enforceable remedies where a data collector and/or processor fails to adhere to applicable law.

Our Use and/or Disclosure of Collected Information

In addition to the foregoing, we may use Information, including, but not limited to, PII, to:

  • Present our Website and its contents to you;
  • Help to establish and verify the identity of users;

This Privacy Policy applies solely to Information collected through our Website. In an attempt to provide you with increased value, we may include third-party links on our Website or integrate the Website with third-party applications. These linked sites and applications have separate and independent privacy policies and we may not have any control or rights in such third-party sites and applications. We, therefore, have no responsibility or liability for the content and activities of these linked sites or applications, or your activities conducted through them. Accessing and Correcting Your Information

We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

As noted above, residents of certain states, such as California, Nevada, Colorado, Virginia, and Utah may have additional personal information rights and choices.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. If and where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Information/PII, we cannot guarantee the security of any Information transmitted to our Website. In the event that a known data breach occurs, the Company shall notify all individuals whose information was potentially affected within one (1) business day of the Company becoming aware of the breach. Following this breach, HCSC will take all necessary steps to mitigate any loss of data and to prevent future data breaches.

Our Policy Toward Children

The Website is intended to be used only by users who have reached the age of majority in the jurisdiction in which they reside (which in most states is 18 years old) or who have reached the age of 16 and have the permission of a legal guardian (e.g., a parent) to use the Website. If you are under the age of 16, you may not use the Website or any content, materials, products or services made available on or through the Website. We do not knowingly collect PII from children under the age of 16. If you are under the age of 16, do not use, or provide any information on, this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received PII from a person under the age of 16 without verification of parental consent, we will delete that information.
